If you are unable to repay your debt, you may, in certain cases, apply for debt relief. This means that your debt is either written off or reduced to an amount that the Probate Court assesses you are able to pay under an instalment arrangement (typically over 3 years).

 

Who can obtain debt relief?

To obtain debt relief, you must meet a number of conditions:

  • You must have debts of a certain size that you are unable to repay now or within the next few years
  • You must achieve a lasting improvement in your financial situation through debt relief
  • It may be an advantage if you have permanent employment, a stable income and stable housing circumstances
  • The Probate Court may require you to sell valuable assets before debt relief can be granted

Note: If you are unemployed or have unresolved financial circumstances, it may be more difficult to have a debt relief application approved.
